1. Acceptance of Terms

Your use of the Site constitutes your agreement to these Terms. We encourage you to review these Terms before each visit, as they may be updated from time to time. Continued use of the Site following any posted update constitutes acceptance of the revised Terms.

2. About ATTUNED

ATTUNED (Affective Teacher Training in Understanding Emotional Development) is an educational program developed by the professional staff of the Lucy Daniels Center. ATTUNED is designed to help teachers and school administrators create classroom and school environments that support the emotional development of children. The program includes modules addressing the emotional environment, educator relationships, and affective communication.

ATTUNED is a program of LDC. It is not a separate legal entity. All contractual relationships created by these Terms are between you and the Lucy Daniels Center.

3.  Intellectual Property

All content on the Site and within the ATTUNED courses — including but not limited to videos, PDFs, module outlines, written materials, and the ATTUNED framework itself — is the sole intellectual property of the Lucy Daniels Center. This content was developed by LDC professional staff and is protected by applicable copyright and intellectual property laws.

3.1  License to You

Subject to your compliance with these Terms, LDC grants you a limited, personal, non-exclusive, non-transferable license to access and use course materials solely for your own professional development purposes.

3.2  Prohibited Uses

• You may not, without the express prior written consent of LDC:
• Remove or alter any copyright, trademark, or other proprietary notices contained in the materials.
• Record, copy, reproduce, or download course content beyond what is necessary for personal use;
• Redistribute, resell, sublicense, or share access to course materials with any third party;
• Use course content to develop, create, or market a competing educational product or program; or
• Remove or alter any copyright, trademark, or other proprietary notices contained in the materials.

4. Educational Disclaimer

4.1  Not Clinical or Professional Advice

ATTUNED courses are designed for professional development purposes for teachers and school administrators. While the program was developed with clinical expertise and informed by clinical practice, the courses do not constitute psychological, medical, or clinical advice. The materials are not intended to guide clinical decisions about specific students or individuals and should not be used for that purpose.

4.2  No Guarantee of Results

LDC provides educational tools and frameworks for supporting emotional development in school settings. The outcomes of applying these strategies depend on the individual educator’s practice, skill, and environment. LDC makes no representations or warranties regarding the results of applying ATTUNED methods.

4.3  Professional Responsibility

Educators and administrators who complete ATTUNED courses remain solely responsible for their own professional judgments and decisions in their classrooms and schools.

5.  Account Responsibilities

To access certain features of the Site, including course enrollment through our learning management platform, you will be required to create an account. You agree to:

• Provide accurate and complete registration information;
• Maintain the confidentiality of your login credentials;
• Notify us promptly at info@lucydanielscenter.org of any unauthorized use of your account; and
• Accept responsibility for all activity that occurs under your account.

Account access is limited to individuals 18 years of age or older.

6.  Course Access and Fees

ATTUNED courses are currently offered at no charge to support the professional development of the educator community. LDC reserves the right to modify course access, introduce new content, or implement fees for future premium content offerings. Any material change affecting access for existing enrolled users will be communicated by email in advance of taking effect.

7.  Professional Development Credit

LDC intends to seek approval from the North Carolina Division of Child Development and Early Education (“NCDCDEE”) for ATTUNED course completions to qualify as professional development credit. LDC makes no guarantee that such approval will be granted or maintained. Users are responsible for verifying applicable credit requirements with their employers or licensing bodies.

8.  Third-Party Services and External Links

The Site uses third-party service providers to support its operation, including:

• LearnPress — our learning management system, used to deliver course content and track course completion;
• Brevo — our email and communications platform, which handles transactional emails (such as enrollment confirmations and password resets) and stores subscriber contact information as a data processor on our behalf.

The Site may also contain links to third-party websites, including the Lucy Daniels Center website (lucydanielscenter.org). LDC is not responsible for the content, privacy practices, or terms of use of any third-party website or service. Your use of third-party services is subject to the applicable terms and privacy policies of those providers.

9.  Privacy and Data

LDC’s collection, use, and storage of personal information is governed by our Privacy Policy, which is incorporated into these Terms by this reference. 10.  Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE LUCY DANIELS CENTER, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SITE, ITS CONTENT, OR ANY COURSE MATERIALS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT LDC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL LDC’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE EXCEED ONE HUNDRED DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, LDC’s liability shall be limited to the greatest extent permitted by law.

11.  Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. LDC EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. LDC DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

12.  Indemnification

You agree to indemnify, defend, and hold harmless the Lucy Daniels Center and its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use of the Site or course materials; (b) your violation of these Terms; or (c) your violation of any applicable law or the rights of any third party.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Wake County, North Carolina, and you hereby consent to personal jurisdiction in such courts.

14.  Changes to These Terms

LDC reserves the right to modify these Terms at any time. Changes will be posted to this page with an updated “Last Updated” date. For material changes, we will provide notice by email to enrolled users at least fourteen (14) days before the changes take effect. Your continued use of the Site after the effective date of any changes constitutes your acceptance of the revised Terms.

15.  Termination

LDC reserves the right to suspend or terminate your account or access to the Site at any time, with or without notice, for conduct that LDC reasonably believes violates these Terms or is otherwise harmful to other users, LDC, or third parties. Upon termination, the provisions of these Terms that by their nature should survive (including intellectual property, disclaimer, limitation of liability, and governing law provisions) shall continue in full force and effect.

16.  Entire Agreement; Severability

These Terms, together with LDC’s Privacy Policy, constitute the entire agreement between you and LDC with respect to your use of the Site and supersede all prior agreements and understandings. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
